Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious.

COVID Waiver

1 - Clark Basketball Academy (“CBA”) cannot prevent you or your player from becoming exposed to, contracting, or spreading COVID-19 while utilizing CBA’s services or premises.

 

2 - It is not possible to prevent against any presence of the disease. Therefore, if you choose to utilize CBA’s services and/or enter onto any premises in which CBA holds practice or training sessions you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

 

3 - ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19.

 

4 - I hereby choose to accept the risk of contracting COVID-19 for myself and/or my player in order to utilize Clark Basketball Academy’s (“CBA”) services and enter any

premises in which CBA holds practice or games.

 

5 - These services are of such value to me and/or to my player, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize CBA’s services and premises in person if applicable: “rather than arranging for an alternative method of enjoying the same services virtually (e.g. videoconference)]. 

 

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Clark Basketball Academy (“CBA”) and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-

19 related to utilizing CBA’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. CHOICE OF LAW: I understand and agree that the law of the State of Florida will apply to this contract. I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.

INJURY Waiver

​

1 - I agree to abide by all Clark Basketball Academy rules. I am also aware of a wide range of risks and injuries to my child and consent to her participation.

2 - I waive any and all claims I may have against Clark Basketball Academy, its Directors, Officers, members, volunteers, coaches, agents, and heirs, next of kin, successors, agents, or assigns (“The Release”) including any and all claims to damage caused by the negligence of any of them arising out of my participation in basketball and its related activities, together with any costs including attorney’s fees maybe incurred as a result of any such claim whether valid or not and release Clark Basketball Academy its directors, officers, members, volunteers, coaches, agents, sponsors of any liability resulting from injury or death during practice or other completion related activities

3 - I hereby attest that I am physically fit and have trained for this activity.

4 - I hereby consent to receive medical treatment which may be deemed advisable in the event of a medical injury, accident and/or illness during participation with Clark Basketball Academy

5 - I hereby consent that in the event of cancellation of membership, by me or Clark Basketball Academy for whatever reason, any monies in my account will become the property of Clark Basketball Academy.

6 - I agree to the Clark Basketball Academy payment and billing procedure and I understand by signing this I am fully responsible for the entire fee.

7 - I agree to the statement that Clark Basketball Academy is a separate entity than Bishop Kenny HS.

8 - I understand and accept the risks involved with training during the COVID-19 Pandemic, and therefore I agree that Clark Basketball Academy, SMG the Lab or any owner/facility we conduct workouts/practices in is not responsible for any harm or potential exposure to COVID-19 that could be caused by basketball training.
